By coincidence, I have to check every morning 7 different mailboxes. And every working day for me begins with the fact that I spend from 40 minutes to an hour to rake up spam and other garbage. Does it make sense to deal with this?

Knowing that in 2006 the Federal Law On Advertising dated March 13 , 2006 N 38- was issued





Let us try to understand how the Law concerns those who in one way or another have to do with advertising “distributed over telecommunication networks and placed on mailings”. So delicately in Article 18 of the Law is called SPAM.



To begin with, I will quote the “fatal” Article 18 in order not to be unfounded. “Article 18. Advertising distributed by telecommunication networks and placed on mailings”

1. Distribution of advertising over telecommunication networks, including through the use of telephone, facsimile, mobile radio telephone communications, is allowed only with the prior consent of the subscriber or addressee to receive advertising. At the same time, an advertisement is deemed to be widespread without the prior consent of the subscriber or addressee, unless the advertising distributor proves that such consent was obtained. The advertising distributor is obliged to immediately stop the distribution of advertising to the address of the person who applied to him with such a requirement. ”



Thus, the only requirement for an advertising distributor is the prior consent of the subscriber or addressee. It does not say how this consent should be fixed. The only responsibility that the advertising distributor may incur is the obligation to immediately cease the distribution of advertising to the person who has applied to him with such a request.

As of today, no liability for violation of the specified norm of the Law is NOT INSTALLED. It turns out that the long-awaited by many "SPAM Law" was limited to only quiet requests to the "malicious SPAMERS" to stop the mailing, and to the SPECIFIC subscriber from the multimillion base. What is the output? Another early law.
