The US Supreme Court has
prohibited the patent of human genes.
All nine judges stated that naturally occurring biological materials could not be patented, but, as a compromise, they agreed that synthetic versions of the gene material could be patented.
This verdict arose from a trial with Myriad Genetics, a company located in Utah, which was sued through applications for ownership of two patents related to biological material known to us as the BRCA1 and BRCA2 genes. Mutations of these genes increase the chances of hereditary breast cancer and ovarian cancer.
Because Myriad Genetics owns patents for these genes, it is the only company that can test for potential abnormalities.
Over the past 31 years, 20 percent of the human genomes have been patented in the United States.
