The Ministry of Culture proposes to fine users of file-sharing networks for 5000 rubles

The State Duma continues the meeting of a special working group that considers the package of anti-piracy amendments to the legislation on the model of the American DMCA.

In January 2013, the commission considered the first package of amendments, according to which sites and hosters would be obliged to remove unlicensed content upon the first request of the copyright holder, out of court, as is done in the United States.

Now the Ministry of Culture proposes to make another addition to the Federal Law 149- “On Information, Information Technologies and Information Protection”, namely, to introduce the responsibility of end users for distributing unlicensed content, that is, for distributing files through torrents.

Yesterday at the meeting of the working group of the Ministry of Culture proposed to introduce the concept of "user file-sharing network" in 149-FZ. In accordance with the proposed procedure, “the copyright holder sends to the service provider a statement indicating the IP address of the user of the file-sharing network violating copyright or related rights. The operator, in turn, is obliged to redirect him within 24 hours to the user himself and notify him of the need to delete information or block access to it. Otherwise, he faces administrative responsibility on a par with the site owners and providers who ignored the appeal of the owners: 5 thousand rubles. for citizens , 50 thousand rubles. for officials and entrepreneurs and 1 million rubles. for legal entities.

If the user does not take action within 24 hours, the telecom operator has 12 hours to independently remove the information or block access to it. ”

Natalia Romashova, Director of the Legal Affairs Department of the Ministry of Culture, made it clear in an interview with the newspaper Kommersant that the adoption of such amendments was practically resolved: ".

Only a few days left to accept comments from interested parties. The final version of the “Russian DMCA”, taking into account the comments, will be considered on June 3 at the conciliation commission with the participation of representatives of the Ministry of Economy, the Ministry of Education and Science and the working group. Then the project will be submitted for approval to the Ministry of Justice and submitted to the government.

Internet Copyright Management estimates that the damage to Russian right holders from the illegal distribution of content on the Internet is at least € 400 million per year. American copyright holders are actively lobbying for the adoption of laws along the lines of the DMCA in different countries of the world for the unification of world legislation in the field of intellectual property protection.
