The use of car DVRs in Austria is prohibited

In an accident or collision with the arbitrariness of the police or irresponsible drivers, the main argument in favor of these cameras is physical evidence. At least theoretically. Because in Austria, according to ARGE Daten, the use of DVRs is unacceptable.

A local motorist has applied for permission to use "mobile video surveillance" to protect his car and "to perform the due diligence prescribed by law." The Personal Data Protection Commission rejected the application. According to the conclusion of ARGE Daten, motorists with such DVRs can sue. Moreover, they are fined up to 10,000 € (and in the event of a repeated violation, up to 25,000 €). In addition, persons who have unlawfully been filmed on a DVR may claim compensation under civil law up to € 20,000. For such preventive video surveillance there is currently no legal basis.

The petitioner, in a statement, compared the shooting on a DVR with a tourist or sports video. Since the recording was to be used exclusively by the owner of the camera, he considered it to be personal use, and requested an unlimited data retention period. The Data Protection Commission found that permanently recording from a vehicle is essentially video surveillance, and its real purpose is to collect evidence. Therefore, comparison with tourist or sports video filming is illegal. Individuals are allowed to conduct video surveillance only in places completely within their sphere of influence, for example, at home. Video surveillance in public places is allowed only to security services.
