Alternative DNS owner sues ICANN

Name.Space, the creator of the alternative root zone, sued ICANN, accusing the company of violating the rights of trademark owners and competition law. Name.Space believes that ICANN illegally monopolized the scope of new gTLDs.


Back in March of this year, Name.Space made a sensational statement that it has rights to 482 top-level domain names, and that ICANN does not have the right to register them at the request of other users. These names are 482 zones that exist in the alternative domain name system created by Name.Space.

The registrar also claims rights and a discount of $ 83,000 for each of the 118 top-level domains, the application for registration of which he sent to ICANN back in 2000, but did not receive a clear answer about the refusal, and therefore has an advantage over the bidders, but these names under the new gTLD program.

In its Name.Space lawsuit, ICANN requires the delegation to relinquish the delegation of 189 domains that match the alternative DNS names of the claimant. Name.Space also draws attention to the complexity and cost of registering new gTLDs. According to the plaintiff, only the “domain titans” will be able to go through the registration procedure, which will lead to the monopolization of the market for new domains, and this should not be allowed according to the competition laws in California.

The record also indicates a “conflict of interest” in ICANN. A number of company executives, including the former and present Board Chairpersons, Peter Dengate Trash and Steve Crocker, work in organizations related to the domain industry, which also contradicts both the law and the ICANN bylaws, as in this case, ICANN members can make decisions motivated by personal rather than public interests.
