The State Duma of the Russian Federation intends to consider on October 16 a draft law on teleworking, in which the necessary changes will be made to the labor legislation for cases of “remote” work. The press service of the Ministry of Labor and Social Protection, which developed the draft law, explained that the concepts of freelancer would include auditors, accountants, lawyers, translators, designers,
programmers , editors, and journalists.
What are they going to accept? First of all, the employer will be obliged to enter into a formal employment contract with a freelancer; at the same time, the performer will be subject to the same rights and obligations as ordinary workers. Also, the concept of a “remote workplace” will be introduced into the Labor Code of the Russian Federation, some features of certification of such workplaces, mode and labor protection will be described. It is stated that a freelancer, entering into an employment contract, will be able to provide all documents in electronic form, avoiding the services of regular mail.

One of the problems of remote labor is the difficulty of documenting. The draft law proposes to establish the possibility of using enhanced qualified electronic signatures when drafting an employment contract electronically, where signatures of the parties are required. The employer will be obliged to send to the remote worker a duly certified copy of the employment contract by mail by registered letter notifying no later than three calendar days from the date of the employment contract
An employee performing work outside the location of the employer will allocate his working time and rest time at his discretion, unless otherwise provided by the employment contract. In all other aspects, including guarantees of labor laws, the employee will have the same rights as any other employee of the employer.
Back in February of last year, Russian President Dmitry Medvedev stated the need to expand opportunities for teleworking of citizens. From some
reviews, it follows that almost 40% of Russians would like to work remotely and independently plan their work schedule.
