A German court has declared file hosting company responsible for the content posted by users.

Actually, we are talking about the RapidShare file sharing service known to all of us. This service is trying to separate the "flies from cutlets", that is, myself from the pirates for a long time. So far, RapidShare somehow succeeded, despite all sorts of lawsuits. Nevertheless, yesterday a German court ruled that file-sharing services were responsible for the content posted by users.

It all started with the fact that Atari sued RapidShare for distributing (voluntarily or unwittingly, Atari did not care) the Alone in the Dark game, of course, to the pirate. The trial ended with a victory for Atari, but Rapidshare disagreed with the verdict and filed an appeal. And now the appeal is rejected, and the administration of the service will have to be responsible for the content posted by users.

It should be noted that the court decision is not a direct indication that the service will now have to filter the content posted by users. Moreover, not so long ago some rules were adopted in the European Union, which remove the obligation to filter content from file sharing sites. So Rapidshare this time can get off easy fright, and just delete all copies of the ill-fated game. Thus, the incident is likely to be settled.

Also, the service will have to filter the content added by users for new copies of “Alone in the Dark”. It is also interesting that the German court did not exactly indicate to the file sharing service what to do in the future. The case will be sent to the regional court, which already decides what and how the administration of the service will need to be done.
