The prefix Microsoft Xbox 360 S may be banned for sale in the US after the verdict of the International Trade Commission (ITC). In a court document released on May 21, 2012, ITC Judge David Shaw recommended stopping sales for both 4 and 250 GB versions of the console. His recommendations relate to a ruling issued last month regarding Microsoft’s violation of four Motorola patents related to the H.264 video format. This was reported by Electronista.
Microsoft is obligated to pay a legal deposit in the equivalent of 7% of the wholesale price of unsold US Xbox 360 consoles, and in the long term the company faces a ban on further imports. Despite the fact that this ban was made as a recommendation, the review of the decision, before it comes into force, remains under the jurisdiction of a six-member trade commission.
In previous documents related to the case, there was harsh criticism of Judge Shaw about the actions of Motorola, in respect of which it was said: "There is no evidence that any other company agreed to the proposal that Motorola sent to Microsoft." The statement was made with reference to the authoring rate of 2.25% claimed by Motorola for products related to Windows 7, Internet Explorer 9 and Xbox 360, which the judge found unwise. Despite this, until Microsoft makes a formal licensing agreement with Motorola, the ban is likely to be implemented.
