SMART Jobs Act: Employment for International Students in the USA

Talented students from all over the world come to study in US universities, but after receiving a diploma, many are forced to leave because the term of a student visa is expiring and they have no right to work on it. Each year, 20,000 graduates leave America.

To remedy the situation and help young talents stay in America (and benefit the American economy), senators from the Republican and Democratic parties jointly developed the SMART Jobs Act (Sustaining our Most Advanced Researchers and Technology) bill.

If the bill passes, then a new F4 student visa is created; it will allow a foreign student to stay in the United States for up to 12 months after graduation to find a job or create their own startup.

As soon as the graduate has found a job, he can receive the so-called “green card STEM” (STEM green card). The abbreviation STEM stands for four professional areas: science, technology, engineering, and mathematics — these are the new laws that apply to them.

Holders of such a green card will not be included in the national quota for immigrants, which is strictly regulated by the government. This is a very important point, because holders of such cards will not be subject to discriminatory laws against the employment of immigrants, which they now adopt in certain states of the United States, including Arizona and Alabama.

The authors of the bill provide statistics that immigrants have founded a quarter of all startups that have received venture funding in the United States over the past 15 years. In addition, they account for about half of the graduates of American universities in high-tech specialties. More than 40% of Fortune 500 companies are based on immigrants or their children.
