The court recognized that the Russian Union of Rights Holders (RSP) was registered illegally
The Akushinsky District Court of the Republic of Dagestan on March 2 declared illegal the registration of the RSP organization in the Ministry of Justice (a scan of the 40-page solution was posted on the ROSP website ).
The lawsuit demanding recognition of the illegality of the RSP was filed by the singer Kurbanmagomedov, in court his interests were represented by the lawyer of the Russian Society for Related Rights (ROSP) Azamat Shapiyev. Kurbanmagomedov pointed out that, in accordance with the Civil Code, only authors, performers and producers of phonograms, etc., have the right to receive remuneration for the use of copyrights, and there are practically no rightholders among the founders of the RSP.
Court decision: “Recognize the decision of the Ministry of Justice of the Russian Federation on state registration of a non-profit organization All-Russian Public Organization Russian Union of Rights Holders,” issued by decree of December 10, 2009 No. 5341 - p void and cancel ')
On the filing of the appeal at the RSP is a month.
Upd.RSP response to the court decision and participation in the trial of the representative of ROSP.
Ps. The participation of ROSP lawyers in this matter seems quite natural. At least 1% of royalties from manufacturers and importers of audio and video equipment and storage media is at stake. ROSP has long been trying to win over the tax collection on the blanks, but the RSP is still holding tight to the feeder .
