On January 31, amendments and additions were introduced to some legislative acts of the Republic of Kazakhstan on intellectual property issues (Law of the Republic of Kazakhstan dated January 12, 2012 No. 537-IV “On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Intellectual Property”).
Now, according to the new amendments to the Criminal Code of the Republic of Kazakhstan, illegal use of copyright or related rights objects by organizing, creating Internet resources for further access to the exchange, storage, movement of copies of works or objects of related rights in an electronic digital format, causing significant damage, is punishable by a fine in the amount of from 600 to 800 MCI (from 970,800 tenge to 1,294,400 tenge), either by engaging in public works for a period of 200 to 240 hours, or by restraint of liberty for up to 1 year.
If these acts are committed repeatedly, by a group of persons in a preliminary conspiracy or by an organized group, on a large scale, cause major damage or are committed by a person using his official position, then this is already punished with imprisonment of 2 to 5 years with confiscation of property or without her

Three departments will immediately monitor the execution of the law - the Ministry of Justice of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan and the Financial Police.
Sellers and buyers of counterfeit goods (disks, books, or other objects of copyright or related rights) also have a hard time — purchasing, storing, moving, or making counterfeit copies for marketing purposes is a significant amount punishable by a fine of between 500 and 700 MCI (from 809 000 tenge to 1 132 600 tenge), either by engaging in public works for a period of 180 to 240 hours, or by restriction of freedom for up to 1 year.
Also, changes were made and the Code of Administrative Offenses of Kazakhstan. For illegal use of copyright or related rights, that is, the acquisition, storage, transfer or manufacture of counterfeit copies (except for use on the Internet) for marketing purposes, the assignment of authorship or coercion to co-authored, if these actions do not contain signs of a criminal offense, entail fine on individuals in the amount of from 10 to 15 MCI (from 16,180 tenge to 24,270 tenge), on officials - in the amount of 20 to 30 MCI (from 32,360 tenge to 48,540 tenge), on legal entities - in the amount from 100 to 150 MCI (from 161 800 those n 242 700 tenge) with confiscation of copies of copyright works and (or) related rights, as well as objects, which were the instruments of the offense.
