Patent wars continue, and it seems that in this war there can be no definite winner or vanquished. Not so long ago, Apple was "on horseback", having managed to ban the sale of competitive tablets from Samsung. Now, the “Yablochnik” has to endure the consequences of lawsuits from the domain sphere. At this time, Motorola won, accusing Apple of violating certain patents.
The German court agreed with Motorola, and the claim of this company against Apple was satisfied. So far, Motorola has received only a preliminary opinion, which may affect the fate of Apple devices in Germany. The fact is that with special diligence, Motorola will be able to achieve a ban on the sale of some Apple devices (the most likely candidates to ban sales are the iPhone and iPad, and so far only in Germany) who violate patent laws. However, this step can be quite difficult, because Apple works in Germany not directly, but through a subsidiary, which allows to avoid so far a ban on sales of “violators” devices.
')
As previously reported, the violations relate to two Motorola patents that are related to wireless data transmission. Now Apple continues to sell its devices without restrictions. But this threatens corporations with further proceedings and even with a fine of a quarter million euros. Representatives of the company have already reported that nothing terrible happened, and the sale of devices in Germany, the court decision will not affect (somewhere we have already heard, right?).
All this becomes even more interesting if we remember that Google already several months ago began to carry out a transaction to acquire the assets of the Motorola Mobility division. In this case, go to Google patents from the mobile field, which previously belonged to Motorola. It is necessary to think that the proceedings will continue, and the simple decision of the district court of Germany Motorola (we read - Google) will not stop.
