The attack on the free Internet in Ukraine: the Law of Ukraine "On the protection of public morality"

image Two weeks ago, the Ukrainian government approved the draft law “On internal trade”, which describes the rules for the operation of online stores. This bill applies only to online stores. But this did not calm down. A week ago, in the first reading, the Verkhovna Rada quietly voted for amending the law “On the protection of public morality”, which contains a set of rules on which the site can be closed by providers during the day as well as issuing information to law enforcement agencies about the owner of the resource.

Let's take a closer look at this bill.


Look at article 11:
')
It is prohibited to place and distribute in telecommunication networks the products specified in Section 10 of this Law.

Operators and providers of telecommunications, providing services for the placement, storage and access to electronic information resources (websites), as well as Internet access services, are required to :
...
take immediate (during the day) measures to limit free access to electronic information resources (their parts), determined by the National Commission of Ukraine on the protection of public morality erotic;

if there is a court decision, provide with technical means the removal of content that damages public morality, including child pornography, from the national segment of the Internet, and in terms of its location outside Ukraine, secure blocking of access to it from the national segment of the Internet ;

at the request of law enforcement agencies in the framework of measures to counteract the dissemination in telecommunications networks of information that harms public morality, to provide information without delay through which you can establish :

the type of information service, the identity of the user of the service and other information that can be obtained through an agreement or service agreement;

the place of installation of telecommunication equipment, the time and place of creation, the functioning of information resources and data on access to them by users of telecommunication systems .

TV and radio companies, providers of software services that operate in Ukraine are prohibited from creating, distributing, broadcasting (retransmitting) film, audio, video products, television and radio programs (broadcasts), providing services of viewing or listening to products prohibited from circulation on the territory Of Ukraine in accordance with Article 10 of this Law.


Fun, right? Now let's see what so frightened the moralists (Article 10):

Article 10. Prohibition of the production and circulation of products that harm public morality

In order to prevent the production and circulation of products that harm public morality, it is prohibited :

1) conducting entertainment events, production and turnover of any product that:
propagandizes war, change by violence of the constitutional system or territorial integrity of Ukraine, terrorism, other manifestations of criminal activity;
promotes national, racial and religious hostility, in particular racism, xenophobia, Ukrainophobia, anti-Semitism;
promotes fascism and neo-fascism;
humiliates or insults a nation or a person based on nationality;
promotes disrespect for national and religious shrines;
humiliates the person, is a manifestation of bullying mentally ill, elderly people, people with physical disabilities (injury);
promotes the use of toxic, narcotic, psychotropic substances, alcoholic beverages, smoking;
promotes violence and cruelty;
promotes prostitution, pimping, human trafficking, the creation and distribution of pornographic products;

2) production and turnover of pornographic products;

3) the manufacture (production), treatment, offer or provision of access to products containing child pornography;

4) placing announcements about intimate meetings for remuneration in any mass media, as well as their distribution in any other way;

5) the use of obscene curses and rude words in the production of printed media, in television and radio programs (programs) distributed during the airtime in the daily segment from 6:00 to 23:00, except for channels with limited access, in advertising, mobile content, in computer games and other games for children, in publishing products designed for children, as well as in children's video and audio products, films that do not have a restriction to the audience, or are intended for viewers under 16.

The termination of the publication of the print media, for the dissemination of information in violation of the requirements provided for by this Law, as well as the prohibition of the demonstration of films, programs, information materials, entertainment events, etc., which are detrimental to public morality, is carried out by court order.
