
We all remember the high-profile events of this summer related to the leakage of personal data of users of online stores. Roskomnadzor, which conducted an online shopping check for a violation of the law on personal data, revealed that personal data of 80 online stores were publicly available. As a result, the department transferred cases to the prosecutor's office only for 15 stores, which “missed” the personal data of users in large volumes.
Today, administrative cases are initiated against two owners of online stores. Their names were not disclosed, but it is known that there are no well-known and large retailers among them.
This is the first case of judicial practice against owners of IM, who violated the Law on Personal Data.
Perhaps, in this whole story,
two points are interesting .
1. Proof of the fact of data leakage (in this case, an evidence base is needed, which will be accepted by the court).
2. Creating a precedent (law enforcement practice will affect the “fate” of subsequent offenders).
