First arrest for possession of the virus

38-year-old Yasuhiro Kawaguchi (Yasuhiro Kawaguchi) was the first person in Japan arrested for possession of the virus . This became possible after July 14, 2011 the Upper Chamber of the Judicial Affairs Committee of Japan approved the law adopted by the Parliament (Penal Code). In accordance with it, the creation, distribution or even storage of malware (for the purpose of distribution) is a criminal offense and incurs a punishment of up to three years in prison and a fine of up to 500 thousand yen ($ 6,200).

Although Kawaguchi has already admitted that he is the author of the virus, he will be judged for storing malware, because he wrote the virus before adopting the relevant law. Accordingly, for him the maximum penalty is two years in prison and 300 thousand yen ($ 3,720).

The virus, created by Kawaguchi, copied large volumes of files on the victim's computer, causing the system to slow down or freeze. Malicious software was disguised as a file with child pornography and spread via torrents. According to the police, more than 2,000 people suffered from the actions of the criminal.
