The Belgian group won a lawsuit against a theater that violated the Creative Commons license.
Confirmed the strength of the license CC BY-NC-ND. Lichôdmapwa won a court in a theater company in Brussels that commercially used the reworked song of the group in an advertisement. One of the group members heard their song on the radio and wrote to the company, but it didn't work out and the parties met in court.
The court recognized that the license terms clearly stipulate that the song 1) cannot be edited, 2) cannot be used for commercial purposes, 3) must be published with indication of the authorship. This destroyed the defense claims that they were not warned about the conditions - they were very clearly stated on the site from which the song was downloaded . For each violated condition the group will be paid 1500 €.
It's always nice to see how Creative Commons licenses can protect creative work from misuse. If you read French, read the full text here . ')
