On Friday, the State Duma adopted a very important
bill for IT companies on introducing a preferential 14 percent rate of insurance payments to extrabudgetary funds for organizations operating in the field of information technologies, whose staff is at least 50 people and the share of income from the sale of IT products (services) not less than 90%.
According to the text of the draft law, such an organization recognizes “Russian organizations engaged in the development and implementation of computer programs, databases on a tangible medium or in electronic form via communication channels regardless of the type of contract and (or) providing services (performing works) for developing, adapting, modifying computer programs, databases (software and information products of computer equipment), installation, testing and maintenance of computer programs, databases. "
However, to get into the circle of beneficiaries, it is not enough to meet this definition. It is also necessary to obtain state accreditation.
')
How to get state accreditation Such accreditation is carried out by the Federal Agency for Information Technology. An IT organization that submitted documents according to the
Decree of the Government of the Russian Federation “On state accreditation of organizations operating in the field of information technologies” can get into its register. The list of documents includes an application for state accreditation, a certificate confirming the implementation of activities in the field of information technology, an extract from the Unified State Register of Legal Entities and copies of constituent documents.
In the Resolution itself it is proposed to submit the documents directly by a representative of the organization, or by mail by registered mail. However, this service
is available in electronic form. What is nice, application and help templates, as well as their samples are available for download. After filing a complete package of documents, the decision Rosinformtekhnologii must be made within 30 working days.
What can they refuse to accreditThey can refuse in three cases: if the organization has submitted not all the documents, if the documents are filled out incorrectly or if the data indicated in the certificate of the organization’s activities do not correspond to reality. Probably, it is these data Rosinformtekhnologii check more than a month.
If the Federal Agency for Information Technology denied accreditation, an IT company can re-submit documents, removing the reason for which it was denied.
What is interesting, according to the Resolution, in relation to an already accredited organization, an inspection can be made for compliance with the actual activity. In other words, if the organization took 30 working days, while Rosinformtekhnologii verified the data from the certificate with reality, it produced software, and after receiving accreditation it began to sew socks - the authorized federal agency suddenly appeared and canceled the accreditation within 5 working days.
UPD : Today, October 13, 2010, the Federation Council approved a
draft law on the introduction of benefits for IT organizations and sent it for signature to the President of the Russian Federation.
