"Wikimedia RU" formulated proposals for improving GK4

I think everyone knows that the laws in Russia are imperfect. This fully applies to copyright law, the notorious GK4.
To improve the existing situation, the Wikimedia RU Foundation (local branch of the Wikimedia Foundation, which provides the material basis for the free encyclopedia Wikipedia ), formulated a number of proposals to improve the legislative framework, which are designed to facilitate the creation and dissemination of free knowledge.


A total of 10 sentences were formulated (here only squeeze, the argument can be found in the full text of the sentences):
  1. Legislative consolidation of free licenses - securing the ability to publish their works on the terms of free licenses at the level of law ( Creative Commons , GNU FDL , etc.)
  2. The introduction of the freedom of panorama is the fixing of the appearance of freely accessible objects and the distribution of one’s own works without on any terms and conditions without the consent of the copyright holder. A typical example is photographing buildings for distribution under free licenses.
  3. Changing the duration of copyright for some types of photos - the division at the level of the law of photos into artistic, documentary and trivial (passport photo, for example) with different conditions for the protection of the rights of authors.
  4. Changing the duration of the copyright to audiovisual works is the calculation of the term of protection from the day the movie was released on the screen, and not from the day the authors died. It sounds probably absurd, but one of the first films “The Arrival of a Train” (1896) is still protected by copyright, since the eldest of the Lumiere brothers died in 1954.
  5. Changing the duration of copyright to works of science - it is proposed to consider scientific publications as a special class of works and allow free non-commercial use one year after publication; It is also proposed to provide free access to the texts of abstracts and dissertations.
  6. Free use of the work for informational, scientific, educational or cultural purposes, regardless of the method of reproduction - current legislation effectively prohibits Fair use in electronic form.
  7. The abolition of the ban on digitization of funds by libraries and archives is now the creation of copies of works without the consent of the author is permissible, but not in electronic form.
  8. Translation into the public domain of works belonging to the Government of Russia and other state bodies of the Russian Federation - ensuring the free use of works that were created at the expense of taxpayers.
  9. Cancellation of provisions, further extending the term of copyright in works - the abolition of several provisions that extend the term of copyright. For example, the classic novel “The Master and Margarita” is not in the public domain only because it was published in 1966-67, 26 years after the death of the author, and the rights will expire only in 2038.
  10. The admissibility of fair use and mitigation of punishment for violations - the extension and clarification of the provision on fair use, the abolition of the minimum amount of compensation and criminal liability for violation of copyright and related rights.

At the moment, the proposals are being finalized and will soon be sent to the Council under the President of the Russian Federation on codification and improvement of civil legislation and other state organizations.
